Article 3 – Scope
These general terms apply to every offer from the trader and to every distance contract concluded and every order placed between the trader and the consumer.
Before the distance contract is concluded, the text of these general terms will be made available to the consumer. If this is not reasonably possible, the consumer will be informed, before the distance contract is concluded, that the general terms can be read at the trader's premises and that they will be sent free of charge as soon as possible at the consumer's request.
If the distance contract is concluded electronically, the text of these general terms may, notwithstanding the previous paragraph, be made available to the consumer electronically before the contract is concluded, in such a way that the consumer can easily store the terms on a durable medium. If this is not reasonably possible, it will be stated before the distance contract is concluded where the general terms can be read electronically, and that they will be sent free of charge, electronically or otherwise, at the consumer's request.
If specific product or service terms apply in addition to these general terms, the second and third paragraphs apply accordingly. In case of conflicting provisions, the consumer may always rely on the applicable provision that is most favourable to them.
If one or more provisions of these general terms are at any time wholly or partly invalid or void, the contract and these terms will otherwise remain in full force. The provision concerned will be replaced without delay, by mutual agreement, by a provision that comes as close as possible to the purpose of the original one.
Situations that are not covered by these general terms will be assessed in accordance with the spirit of these general terms.
Any uncertainty about the interpretation or content of one or more provisions of our general terms will be interpreted in accordance with the spirit of these general terms.
Article 4 – The offer
If an offer has a limited period of validity or is subject to specific conditions, this is expressly stated in the offer.
The offer is not binding. The trader has the right to change and adjust the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is detailed enough to enable the consumer to make a proper assessment of the offer. If the trader uses images, these are a true representation of the products and/or services offered. Obvious errors or mistakes in the offer do not bind the trader.
All images, specifications and data in the offer are indicative only and cannot be the basis for claims for damages or for termination of the contract.
Product images are a true representation of the products offered. However, the trader cannot guarantee that the colours shown exactly match the actual colours of the products.
Every offer contains information that makes clear to the consumer what rights and obligations are attached to accepting the offer. This applies in particular to:
- the price, including taxes;
- any shipping costs;
- how the contract is concluded and what steps are required for this;
- whether or not the right of withdrawal applies;
- the method of payment, delivery and performance of the contract;
- the period for accepting the offer or the period during which the trader guarantees the price;
- the cost of using means of distance communication, if this is calculated on a basis other than the normal basic rate;
- whether the contract is archived after it is concluded and, if so, how the consumer can access it;
- how the consumer can check and, if necessary, correct the information provided under the contract before the contract is concluded;
- any other languages in which the contract can be concluded; the codes of conduct to which the trader is subject and the possibility for the consumer to consult these electronically;
- the minimum duration of the distance contract in the case of continuing contracts.
Optional: available sizes, colours and material types.
Article 5 – The contract
Subject to the provisions of paragraph 4, the contract is concluded at the moment the consumer accepts the offer and meets the conditions stated in it.
If the consumer has accepted the offer electronically, the trader will immediately confirm receipt of the acceptance electronically. As long as the trader has not confirmed receipt of this acceptance, the consumer can cancel the contract.
If the contract is concluded electronically, the trader will take appropriate technical and organisational measures to secure the electronic data transfer and ensure a safe web environment. If the consumer can pay electronically, the trader will take appropriate security measures for this purpose.
The trader has the right, within the limits of the law, to check whether the consumer can meet their payment obligations and to obtain information about all facts and circumstances relevant to responsibly entering into the distance contract. If, as a result of this check, the trader has good reason not to enter into the contract, the trader has the right to refuse an order or request, stating reasons, or to attach special conditions to its performance.
The trader will provide the consumer with the following information with the product or service, either in writing or in a way that allows the consumer to store it easily on a durable medium:
- the visiting address of the trader's place of business where the consumer can submit complaints;
- the conditions for, and the way in which, the consumer can exercise the right of withdrawal, or a clear notice that there is no right of withdrawal;
- information about guarantees and existing after-sales customer service;
- the information referred to in Article 4, paragraph 3 of these terms, unless the trader has already provided this information to the consumer before performance of the contract;
- the conditions for terminating the contract, if the contract runs for more than one year or for an indefinite period. For continuing contracts, the previous paragraph applies only to the first delivery.
Every contract is concluded on the condition that the products concerned are available in sufficient quantity.
Article 6 – Right of withdrawal
When purchasing products, the consumer has the right to withdraw from the contract within 30 days of receiving the products without giving a reason, provided that the products are unworn, unwashed and in their original condition with tags attached. The consumer may choose a refund or an exchange for any other size or colour, subject to availability. The withdrawal period starts on the day after the consumer, or a representative designated in advance by the consumer and notified to the trader, has received the product.
If the consumer exercises the right of withdrawal, they must return the product to the trader in the original packaging with intact seals and packaging closures, in accordance with the reasonable and clear instructions provided by the trader.
If the consumer wishes to exercise the right of withdrawal, they must notify the trader within 30 days of receiving the product. The consumer must do this by written notice or by email. After notifying the trader of the intention to exercise the right of withdrawal, the consumer must return the product within 30 days of that notification. The consumer must be able to prove that the delivered goods were returned in time, for example by showing proof of postage.
If the consumer fails to notify the trader of the intention to exercise the right of withdrawal, or fails to return the product to the trader within the time limits stated in paragraphs 2 and 3, the purchase becomes binding.
Article 7 – Costs in the event of withdrawal
If the consumer exercises the right of withdrawal, the consumer bears the costs of returning the products.
If the consumer has made a payment, the trader will refund the amount as soon as possible, but no later than two business days after the returned product has been received. This assumes that the product has already been received by the trader or that sufficient proof of return can be shown.
Article 8 – Exclusion of the right of withdrawal
The trader may exclude the consumer's right of withdrawal for products as described in paragraphs 1 to 8. The exclusion of the right of withdrawal applies only if the trader has clearly stated this in the offer or, at the latest, in good time before the contract is concluded.
Exclusion of the right of withdrawal is only possible for products:
- that have been made by the trader in accordance with the consumer's individual specifications;
- that are clearly personal in nature;
- that by their nature cannot be returned;
- that can spoil or age quickly;
- whose price depends on fluctuations in the financial market that the trader cannot influence;
- for individual newspapers and magazines;
- for audio and video recordings and computer software where the seal has been broken by the consumer;
- for hygiene products.
Exclusion of the right of withdrawal is only possible for services:
- relating to accommodation, transport, catering or leisure activities that are to be provided on a specific date or during a specific period;
- where performance has begun with the consumer's express consent before the withdrawal period has expired;
- relating to betting and lotteries.
Article 9 – The price
During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes resulting from changes in VAT rates.
Notwithstanding the previous paragraph, the trader may offer products or services at variable prices where the prices are linked to fluctuations in the financial market that the trader cannot influence. This link to fluctuations, and the fact that any prices stated are indicative, will be stated in the offer.
Price increases within three months of the conclusion of the contract are only permitted if they are based on statutory regulations or provisions. Price increases taking effect three months or more after the conclusion of the contract are only permitted if the trader has agreed this and:
- they are based on statutory regulations or provisions, or
- the consumer has the right to terminate the contract on the date the price increase takes effect.
The prices stated in the offer for products or services include value added tax (VAT).
All prices are subject to typing and writing errors. No liability is accepted for the consequences of typing or writing errors. In the event of a typing error, the trader is not obliged to deliver the product at the incorrect price.
Article 10 – Performance of the contract and guarantee
The trader guarantees that the products and/or services comply with the contract, the specifications stated in the offer, reasonable requirements of quality and/or usability, and the statutory provisions and/or government regulations applicable at the time the contract was concluded. If agreed, the trader also guarantees that the product is suitable for use other than normal use.
Any guarantee provided by the trader, manufacturer or importer does not affect the statutory rights and claims that the consumer can assert against the trader under the contract.
Any defects or incorrectly delivered products must be reported to the trader in writing, with photos, within 30 days of delivery. Defective or damaged products will be replaced free of charge. Products must be returned in the original packaging and in new condition.
The trader's guarantee period corresponds to the manufacturer's guarantee period. However, the trader is never responsible for the ultimate suitability of the products for any specific application by the consumer, or for recommendations regarding the use or application of the products.
The guarantee does not apply if:
- the consumer has repaired and/or modified the delivered products themselves or has had third parties repair and/or modify them;
- the delivered products have been exposed to abnormal conditions, otherwise handled incorrectly or used contrary to the instructions of the trader and/or on the packaging;
- the unsuitability is wholly or partly attributable to government regulations that have been or will be issued regarding the nature or quality of the materials used.
Article 11 – Delivery and performance
The company will take the greatest possible care when receiving and processing orders for products.
Delivery will be made to the address that the consumer has given to the company.
Subject to the provisions of Article 4 of these general terms, the company will execute accepted orders as soon as possible, but no later than within 30 days, unless the consumer has agreed to a longer delivery period. If delivery is delayed, or if an order cannot be executed or can only be executed in part, the consumer will be informed of this no later than 30 days after placing the order. In that case the consumer has the right to cancel the contract at no cost and, where applicable, the right to compensation.
In the event of cancellation under the previous paragraph, the trader will refund the amount the consumer has paid as soon as possible, but no later than 14 days after the cancellation.
If delivery of an ordered product proves impossible, the trader will endeavour to offer a replacement product. A clear and comprehensible notice that a replacement product is being delivered will be given no later than at the time of delivery.
The right of withdrawal cannot be excluded for replacement products. The trader will bear the costs of any return shipping.
The risk of damage to and/or loss of the products remains with the trader until the time of delivery to the consumer or to a representative designated in advance and notified to the trader, unless expressly agreed otherwise.
Article 12 – Payment
Unless another date has been agreed, amounts owed by the consumer must be paid within seven working days of the start of the withdrawal period referred to in Article 6, paragraph 1. For contracts for the provision of a service, this period starts after the consumer has received confirmation of the contract.
The consumer is obliged to inform the trader without delay of any inaccuracies in the payment details provided or notified.
If the consumer fails to pay on time, the trader has the right, subject to statutory limitations, to charge reasonable costs that have been notified to the consumer in advance.
Article 13 – Complaints
Complaints about the performance of the contract must be submitted to the trader with a complete and clear description within 30 days of the consumer discovering the defects.
Complaints submitted to the trader will be answered within two working days of the date of receipt. If a complaint is expected to require a longer processing time, the trader will send a confirmation of receipt within that period and state when the consumer can expect a more detailed answer.
If a complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute resolution procedure.
A complaint does not suspend the trader's obligations, unless the trader states otherwise in writing.
If the trader considers the complaint to be justified, the trader will, at its own discretion, replace or repair the delivered products free of charge.
Article 14 – Disputes
Contracts between the trader and the consumer to which these general terms apply are governed exclusively by the laws of the United Kingdom, even if the consumer lives abroad.
